Terms of Use
In short. These terms are the agreement between you and HexSirius Private Limited for using SiriON. SiriON is a professional community for people in dental practice, with an appointment diary and record keeping tool for your clinic that works whether or not you join Community. It is not a medical device and does not give medical advice: every clinical decision is yours. You are responsible for the patient data you enter and for having the patient's consent. Paid plans are bought through the App Store or Google Play. These terms are governed by Indian law and the courts at Hyderabad have jurisdiction, without affecting your right to approach a consumer commission.
1. Who the agreement is with
1.1 These Terms of Use ("Terms") are an agreement between you and HexSirius Private Limited, a company incorporated in India with corporate identity number U62011TS2026PTC214071 and registered office at H.No. 18-2-34/4/9/A, Ghazi-E-Millath Colony, Bandlaguda, Hyderabad, Telangana 500005, India ("we", "us", "our").
1.2 "Service" means the SiriON app, the website at https://sirionhealth.com and everything we provide through them. Our Privacy Policy, End User Licence Agreement, Community Guidelines and, where they apply, our Subscription terms, Jobs Board terms, AI features notice and Clinician data processing terms form part of these Terms.
2. Accepting these Terms
2.1 You accept these Terms by ticking the box in the app and tapping Accept and continue. If you do not accept them, you cannot use the Service.
2.2 This agreement is an electronic record under the Information Technology Act, 2000. It is generated by a computer system and needs no physical or digital signature.
3. Who may use the Service
3.1 You may use the Service only if you are 18 years of age or older, you are in India, you can enter into a binding contract under Indian law and you are a dental student, a dentist or another person working in dental practice.
3.2 If you use the Service for a clinic or hospital, you confirm that you are authorised to do so.
4. What the Service is and is not
4.1 SiriON has two parts. Community lets you take part in a professional community and find or post dental jobs. The diary helps you schedule appointments, keep patient and treatment records, keep a clinical logbook and send reminders to patients. You can use the diary without joining Community.
4.2 SiriON is not a medical device. It does not diagnose, treat, cure or prevent any condition and it does not give medical advice. You are responsible for every clinical decision and for the accuracy of every record.
4.3 Features that use artificial intelligence, such as the voice assistant, can make mistakes. You must check every detail they produce before you save it.
5. Your account
5.1 Give accurate details and keep them up to date. Keep your password secret and turn on two-step sign-in if you can. You are responsible for what happens in your account.
5.2 Tell us at grievance@sirionhealth.com straight away if you think someone else has used your account.
6. Patient data you enter
6.1 For patient records you enter, you or your practice decide what is recorded and why. You are the data fiduciary and we process that data for you as described in our Clinician data processing terms.
6.2 You confirm that for every patient you record:
- you have the patient's consent, or another basis the law allows, to record and process their data in SiriON, and for a child, the consent of a parent or lawful guardian;
- the data is accurate and limited to what you need;
- you keep records for the periods your professional rules require, and export them before deleting your account if you need them;
- you send messages to patients only with their consent and stop when they ask.
6.3 You must not upload patient data that you have no right to process.
7. Your content and the licence you give us
7.1 You own the content you create in SiriON, including records, posts and messages.
7.2 You give us a non-exclusive, royalty-free licence to host, store, copy, process and display your content only as needed to provide the Service to you and, for Community and Jobs content, to show it to other members as you choose. This licence ends when your content is deleted, except for the periods in our Privacy Policy.
7.3 You confirm you have the rights needed to post your content and that it does not break the law or these Terms.
8. Conduct
8.1 You must not use the Service to host, display, upload, publish, share or transmit anything that:
- belongs to someone else and that you have no right to share;
- is obscene, pornographic, paedophilic, invades another person's privacy including bodily privacy, insults or harasses on the basis of gender, is racially or ethnically objectionable, relates to money laundering or gambling or promotes enmity between groups on grounds of religion or caste with intent to incite violence;
- is harmful to children;
- infringes a patent, trademark, copyright or other right;
- deceives or misleads about where a message comes from or knowingly spreads false or misleading information;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with other countries or public order;
- incites an offence or prevents its investigation;
- contains viruses or code meant to damage or limit any computer resource;
- breaks any law in force;
- identifies a patient, or shares a patient's information, without the patient's consent.
8.2 You must not try to reach data that is not yours, test or break our security, copy or resell the Service, use automated means to collect data from it or interfere with its working.
8.3 If you break these rules, we may remove content, suspend or end your access, or both, at once and without notice where the breach is serious. Where the breach is a crime under a law in force, you may be liable to penalty or punishment, and where the law requires an offence to be reported, we will report it to the authorities.
9. Community and Jobs
9.1 Community and Jobs follow our Community Guidelines and Jobs Board terms. How we deal with reports and legal orders is in our Content removal and takedown policy.
9.2 We do not employ the people who post jobs, check every listing or take part in hiring. Check an employer before you share documents or agree to work.
10. Plans and payment
10.1 The free Community plan is available without payment. Paid plans and free trials are bought through the Apple App Store or Google Play and are governed by our Subscription terms and the store's terms.
11. Our intellectual property
11.1 The Service, its software, design and content (other than your content) belong to us or our licensors. Our End User Licence Agreement sets out what you may do with the app. The name SiriON and our logos may not be used without our written permission.
12. Services provided by others
12.1 Parts of the Service rely on others, such as app stores, speech recognition on your phone, Google Gemini, WhatsApp and push notification services. Their own terms apply to their services and we are not responsible for them.
13. Availability and changes
13.1 We work to keep the Service available, but it may be interrupted for maintenance, faults or reasons outside our control. Keep your own copies of records you must retain; you can export them from the app.
13.2 We may change or stop features. If we stop a paid feature during a paid period, you can ask the store for a refund under its rules.
14. Ending the agreement
14.1 You can stop using the Service and delete your account in Settings at any time. Deleting your account does not cancel a store subscription; cancel it in the store.
14.2 We may suspend or end your access if you break these Terms or the law, or if we must do so by law. Where we can, we will tell you why and give you a chance to export your records first.
15. Disclaimers
15.1 The Service is provided as it is and as available. To the extent the law allows, we do not promise that it will be free of errors or interruptions or that it will suit a particular purpose. Nothing in these Terms excludes a right you have as a consumer that the law does not allow us to exclude.
16. Limits on our liability
16.1 Nothing in these Terms limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else the law does not allow us to limit.
16.2 Otherwise, we are not liable for indirect or consequential loss, loss of profit or loss of goodwill, and our total liability to you for all claims in any twelve months is limited to the greater of the amount you paid for the Service in those twelve months and one thousand rupees.
16.3 We are not responsible for clinical decisions, for the accuracy of records you enter or for your use of information from other members.
17. Indemnity
17.1 If someone brings a claim against us because you broke these Terms or the law, or because of content or patient data you entered without the right to do so, you will cover our reasonable losses and costs from that claim. This does not apply to the extent the claim arises from our own fault.
18. Notices
18.1 We send notices to the email address on your account or through the app. You can send notices to us at grievance@sirionhealth.com or by post to H.No. 18-2-34/4/9/A, Ghazi-E-Millath Colony, Bandlaguda, Hyderabad, Telangana 500005, India.
19. Law and courts
19.1 These Terms are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction, subject to section 19.2.
19.2 If you are a consumer, nothing in these Terms takes away your right to file a complaint before the consumer commission that has jurisdiction where you live or work, under the Consumer Protection Act, 2019.
20. Changes to these Terms
20.1 We may update these Terms. If a change is material, the app will show you a summary and ask you to accept the new version before you continue. We also remind you of these Terms and the consequences of breaking them at least once every three months.
21. General
21.1 If a part of these Terms is found invalid, the rest stays in force. If we do not enforce a term at once, we can still enforce it later. You may not transfer this agreement without our consent.
22. Contact
22.1 Questions and complaints go to our Grievance Officer, Soma Chanakya, at grievance@sirionhealth.com or +91 73962 87866. See our Grievance redressal policy.
